Melissa’s passion is keeping business owners out of legal trouble. Business leaders call Melissa when they need solutions to their employee drama, and she helps them navigate all the state and federal employment laws that impact their decisions. She is well versed in Title VII, ADEA, the Americans with Disabilities Act, FMLA, independent contractor vs. employee classifications, overtime and Fair Labor Standard’s Act compliance, and unemployment appeals.

Melissa is also ready to fight and defend the employer’s decisions in court, when it’s the right decision for the business.  One client nicknamed her “his bulldog” after she won his company’s case.

Starting her career as an employment law counselor to the Georgia Department of Corrections, she quickly learned how to help wardens insist on performance without running afoul of state and federal employment laws. She entered private practice in 2002, putting her expertise to work for businesses the transportation, retail grocery and health care industries. Melissa also learned the ins and outs of purchasing or selling closely held business entities, corporate formations, writing operating agreements, and messy business “divorces” when partnerships end, while being mentored by attorneys with 30+ years in private practice.

Having also interned with the EEOC and Social Security Administration during law school, Melissa uses her government-service experience to bring excellent service to business clients being audited by the federal or state Departments of Labor, or Medicare and Medicaid.

Melissa developed expertise in the federal and state health care laws and regulations while serving as assistant general counsel to hospitals, health systems, hospices and physician practices. Many health care clients trust Melissa review their employment and independent contractor agreements for compliance with the federal Stark and Anti-Kickback laws and regulations. Melissa has the industry knowledge to advise health care clients on employment law matters with the dangers of the False Claims Act, whistleblower statutes and HIPAA minefields in mind.

Melissa became an entrepreneur herself when she founded The Malcom Firm, PC, in 2010, so she could spend more time with her son after her divorce. She keeps an office part-time office in McDonough, GA, to meet with clients outside of the Atlanta area.

Always active in her community, Melissa has served on the boards of The Henry County Chamber of Commerce, Connecting Henry, The Henry Arts Alliance, and her church, McDonough Presbyterian. She is a frequent speaker for SHRM chapter meetings, Chamber meetings, and other business and HR associations. She currently chairs the Small Business Council of the Henry County Chamber of Commerce.

When not practicing law, Melissa enjoys spending time with her partner, Don, and her teen-age son. She supports her son’s sports teams and newest hobbies, like starting a finger board YouTube channel and a ukulele band. Melissa’s own hobbies include running, hiking, cooking, SEC football, and playing piano.
